With thanks to co-organisers, The Propeller Club in Geneva, and sponsors, HFW and MS Amlin, the LMAA held the most recent of its European events at the Metropole Hotel, Geneva on 28 March 2019.

The half day event took the form of a seminar, followed by a forum discussion in which local industry representatives, amongst others, took part.  The audience of around 90 attendees, comprising lawyers, claims handlers and inhouse counsel, representatives of shipping, trading, financial and insurance entities, was drawn from both the local Swiss market and the wider European maritime community, with participants having travelled from as far afield as Constanta, Rotterdam, Paris and Odessa to attend.

The seminar took the form of three papers from the LMAA.  Immediate Past President and LMAA Full Member, Clive Aston provided the audience with an introduction to the LMAA and highlighted the key characteristics of the Association which continue to attracts users to the largest maritime arbitration body worldwide.  Honorary Secretary and LMAA Aspiring Full Member, Daniella Horton focused on the form of the arbitration agreement and highlighted points to be aware of when drafting and operating an arbitration provision.  Former Committee Member and LMAA Full Member, David Martin-Clark concluded the LMAA offering with a presentation on costs, raising some very practical steps which can be taken by all involved in an arbitration (arbitrators, lawyers and the parties themselves) to avoid unnecessary or excessive costs being incurred.

The LMAA papers were followed by two presentations from HFW; London partner, Brian Perrot highlighting the use of innovation in the legal world and local Geneva partner, Michael Buisset offering the audience an update on two recent court decisions, including the Supreme Court decision in the Volcafe case, dealing with the question of burden of proof in relation to cargo damage claims.

A forum discussion then followed chaired by Clive Aston.  Panel Members Bianca to Poele of maritime insurer MS Amlin based in Rotterdam, Jules Drye of metals trading company, Metinvest International SA based in Geneva and Mariella Bottiglieri Green of family shipowning entity, Guiseppe Bottiglieri Shipping joined HFW partners to explain the role and relevance of arbitration to their businesses, the challenges encountered, echoing certain of the points made in the earlier presentations, and setting out their expectations and hopes for the future.

The event was rounded off with a drinks reception, during which lively discussion continued and specific questions were addressed by participants individually.

The LMAA speakers were supported by the Association President, Ian Gaunt, Committee and Full Member Alan Oakley, Aspiring Full Member, Ike Ehiribe and now regular and stalwart supporter, Mrs Martin-Clark.
